Uh... why?
Smash Bros is a fighting game using First Party Nintendo Characters.
Make that "was." On the Japanese site (way back in June 2006), Sakurai stated that Nintendo was looking into putting at least three third party characters in Brawl--including Snake. So, that leaves AT LEAST two slots open. Most suspect that Mega Man (Capcom) and Sonic (Sega) will take those spots, but it's really anyone's game. Realistically, Simon isn't likely, as Snake is already a character representing Konami; that said, there isn't a rule stated by Sakurai in place that says anything about "one character per company."
Another fact that not many may know about:
During the summer of 2006, the Japanese Brawl site took a survey/poll/write-in type of thing where you could suggest characters, stages, and (I believe) musical themes. On the list of characters that got Sakurai's attention was none other than Shimon Belmondo.
So I'd say that he's a possibility, if a bit of a long-shot. Stranger things have happened.
The ONLY reason Snake is in it is because Kojima begged to get him in!
"Begged" is a word that was put in quotations when it was first printed in an article breaking the news of Snake's involvement in Brawl in mid 2006, meaning the word can hardly be taken literally. At most, Kojima probably said, "hey, Sakurai, can Snake be in the game? Please?" And Sakurai probably agreed. Also, Snake was meant to be in Melee but couldn't be squeezed in due to time constraints.
Simon, Alucard, Richter, Sonic, etc ain't gonna be in it.
Unless you know something that the rest of us don't (i.e. live next to Sakurai, happen to be dating Sakurai, work at Nintendo, etc.), you have no reason or evidential backing to make such a claim. Indeed, given the evidence, it's quite possible that Sonic AT LEAST will be in the game (Sakurai and Mayamoto have both stated that Sonic was THE MOST requested third party character), let alone Simon (who, again, apparently received enough fan votes to appear on Sakurai's list of possibilities).
That said, I'd say that Simon may be (at the very least) an assist trophy, if nothing else.
