Well that's nothing new. They said themselves at E3 that they would leave DRM up to the publishers, but that they themselves would have no specific DRM on the CONSOLE. In other words, NO mandatory connectivity, NO mandatory game install and disc obsolescence, and none of that fun stuff related to used games and game sharing.
The PUBLISHER, (EG: Capcom, Konami, etc) can put it on the GAME if they want, but the SYSTEM, the console, will not have any of those features by default.
However, last minute or not, they at least listened. They realized that Microsoft was shooting themselves in the foot repeatedly, and that if THEY listened, and did the opposite, they would win many Xbox fans over, and essentially win E3
